MAGIC FAMILY TRAVELS — TERMS & CONDITIONS

These Terms and Conditions (“Agreement”) govern the travel planning services provided by Magic Family Travels (“we,” “us,” “our”) to the client (“you,” “your”). By engaging our services, you agree to the following terms.

2. Scope of Services
Magic Family Travels provides customized travel planning and booking management services. Our services include, but are not limited to:

Destination and product research

Customized itinerary and trip design

A complete package quote containing 1–3 curated trip options

One (1) revision to the provided options

Price and promotion monitoring through our supplier channels

Supplier communication and booking management

Pre-travel support, defined as email-based assistance to address itinerary questions or clarifications prior to departure

Support during travel, defined as email assistance for urgent issues directly related to reservations booked by Magic Family Travels (availability may vary based on time zone and advisor travel schedule)
2.2 Quote Validity and Pricing Conditions
After the Planning Fee is paid, Magic Family Travels will prepare a complete package quote containing 1–3 curated trip options. You have 15 days from the date the quote is delivered to either:
(a) proceed with one of the quoted packages, or
(b) request one (1) included revision.
After the 15-day window, the Planning Fee is considered fulfilled. If you request additional quotes, revisions, or a restart of the planning process after this period, a new Planning Fee will be required.
All quotes provided by Magic Family Travels are accurate only at the time they are created. Pricing and availability are controlled exclusively by Suppliers and may change at any time, including within the 15-day window. Some Suppliers offer limited hold periods (typically 1–3 days), but most do not guarantee rates or availability until payment is received.
Magic Family Travels is not responsible for changes in pricing, availability, promotions, or inventory occurring after a quote is issued, regardless of when you decide to book.
2.3 Relationship with Suppliers & Payment Procedures
We act as your travel planner and booking agent. All reservations are fulfilled by independent third-party suppliers (“Suppliers”), including hotels, cruise lines, tour operators, and transportation providers.
Except for Magic Family Travels’ own service fees, all payments for travel arrangements are made directly to the Supplier.
For convenience and proper booking management, Magic Family Travels collects your payment information and submits it to the Supplier on your behalf in accordance with the Supplier’s required deposit amounts, payment schedules, and authorization procedures.
Magic Family Travels does not charge, process, or retain Supplier payments. Your payment will be charged directly by the Supplier, and you will receive Supplier-issued confirmations and receipts when applicable.
3. Fees, Pricing & Payment Terms
3.1 Planning Fee
A non-refundable Planning Fee of $250 (€220) per trip is required before any research, quotes, or itinerary design work begins. This fee compensates us for our professional time, expertise, and planning services, regardless of whether travel is ultimately booked. Magic Family Travels reserves the right to waive this fee at our sole discretion.
3.2 Airfare Booking Fee
Airfare Assistance Policy
Airfare research, flight recommendations, and booking assistance are included with all Planning Fee Packages.
Clients who do not purchase a Planning Fee Package may still purchase Airfare Assistance as a standalone service for $50 (€45) per traveler.
Clients who choose not to purchase either a Planning Fee Package or standalone Airfare Assistance are solely responsible for researching, booking, managing, and monitoring their own airfare, including schedule changes, cancellations, airline communications, seat selections, check-in, and any issues that arise before or during travel.
3.3 Group Planning Fees
Group travel planning applies to groups of:

10 or more travelers
Fees are as follows:

+ $25 (€20) per traveler, in addition to the base fee
All group planning fees are non-refundable and due before group planning begins.
3.4 Revision Policy (Excessive Revision Clause)
The Planning Fee includes one (1) standard revision of your initial trip options.
Additional revisions, destination changes, major redesigns, or repeated itinerary overhauls may incur an additional research fee.
This will always be discussed with you in advance and never charged without your consent.
3.5 Payment Processing
Service Fee Payment
Service Fees are payable in the currency specified on your invoice.

3.6 Supplier Payments
Supplier payments (hotels, cruises, tours, etc.) are made directly to the Supplier following their deposit requirements, payment schedules, and authorization procedures.
Magic Family Travels does not retain your payment information beyond the time necessary to submit the required authorization.
3.7 Non-Refundability of Fees
All fees paid to Magic Family Travels — including Planning Fees, Airfare Fees, and Group Fees — are strictly non-refundable, regardless of:

Supplier cancellations or penalties

Personal changes of plans

Destination or date changes
-
Travel disruption
-
Failure to travel

Choosing not to book
4. Client Responsibilities
4.1 Accuracy of Information
You agree to provide complete and accurate traveler information, including full legal names (as shown on passport or government ID), dates of birth, passport numbers, passport validity dates, nationality, special requirements, and any other details necessary to arrange travel.
Magic Family Travels will use the information you provide to make reservations. We are not liable for any costs, penalties, denied boarding, trip disruption, or Supplier fees resulting from incorrect, incomplete, or outdated information provided by you or any member of your travel party.
You are responsible for reviewing all confirmations, invoices, and travel documents issued by Suppliers. Any errors must be reported to Magic Family Travels within 24 hours of receipt. After this period, you assume full responsibility for any inaccuracies and resulting consequences.
4.2 Travel Documentation
You are solely responsible for obtaining and maintaining all required passports, visas, entry permits, vaccinations, and other travel documentation. Passport validity requirements vary by country (often 6 months beyond your return date).
Magic Family Travels is not liable for:

Denied boarding

Entry refusal

Missed flights

Additional expenses

Trip cancellations or disruptions
arising from incomplete, invalid, expired, or improperly obtained travel documentation.
5. Booking & Confirmation
5.1 Booking Process
Suppliers may require a deposit, a credit-card guarantee, a payment authorization, or full payment in order to confirm a reservation. Requirements vary by Supplier.
A reservation is considered confirmed only when all required payment information and any applicable deposits have been successfully submitted to the Supplier. Prices and availability remain subject to change until the Supplier has acknowledged confirmation.
5.2 Changes to Bookings
Modifications to an existing reservation may result in Supplier-imposed fees, fare differences, penalties, or changes in availability. Magic Family Travels will assist with submitting modification requests, but all costs, decisions, and outcomes are determined solely by the Supplier.
6. Cancellations & Refunds
6.1 Planning Fees
All fees paid to Magic Family Travels are non-refundable.
6.2 Supplier Policies
Each Supplier maintains its own cancellation, modification, and refund policies. These policies govern your booking and may include penalties depending on timing, fare rules, or Supplier conditions. Magic Family Travels does not control Supplier-imposed fees, policies, or timelines.
We will provide applicable Supplier policies at the time of booking and will assist with the cancellation or modification process as permitted under each Supplier’s rules.
7. Travel Insurance
We strongly recommend purchasing comprehensive travel insurance. Insurance may provide coverage for trip cancellations, delays, medical emergencies, Supplier default, lost baggage, and other unforeseen events.
Clients who decline coverage acknowledge they may be fully responsible for any financial losses that insurance may have covered. Magic Family Travels is not liable for losses or expenses related to unprotected travel.
8. Communication & Availability
8.1 Official Communication Channel
All official planning, itinerary changes, confirmations, and payment-related communication will take place via email. Messaging platforms (WhatsApp, text, social media) may be used informally but are not considered official communication methods.
8.2 Response Time
Magic Family Travels aims to respond to email inquiries within 1–2 business days. Response times may be longer during weekends, holidays, or advisor travel.
8.3 Support During Advisor Travel
We offer support for urgent travel issues directly related to reservations booked by Magic Family Travels. Availability may vary depending on time zone differences, business hours, and advisor travel commitments.
9. Limitation of Liability
Magic Family Travels is not liable for:

Travel delays, disruptions, or cancellations

Supplier errors or performance issues

Weather events, natural disasters, strikes, or government actions

Acts or omissions of third-party suppliers
-
Personal injury, illness, property loss, or damages
Your travel arrangements are subject to each Supplier’s terms and conditions.
10. Force Majeure
Neither party is liable for failure to perform obligations due to circumstances beyond reasonable control, including natural disasters, acts of terrorism, war, pandemics, or government restrictions.
11. Privacy & Data Protection
We collect only the personal data necessary to arrange your travel.
We share your information only with Suppliers for booking purposes.
We do not sell or distribute your data for marketing.
12. Termination of Services
12.1 Termination by Client
You may terminate services at any time. Fees already paid remain non-refundable.
Where bookings have already been made on your behalf prior to termination, those reservations remain under the management of Magic Family Travels unless and until they are cancelled or formally transferred.
If you request that existing bookings be transferred into your direct control (including supplier access, modification rights, or responsibility for ongoing management), any outstanding service fees and/or commissions earned in relation to those bookings become immediately due and payable in full prior to release or transfer of the reservation.
This includes situations in which you request that bookings be transferred to another travel advisor or agency. In such cases, all outstanding commissions and fees relating to the booking must be settled in full before any transfer of responsibility, access, or supplier ownership is completed.
Alternatively, you may request that Magic Family Travels cancel the existing bookings on your behalf, subject to the applicable supplier terms and cancellation policies.
Magic Family Travels reserves the right to retain access to bookings and act as the primary contact with suppliers for any reservations created during the service period until all outstanding balances are settled.
12.2 Termination by Magic Family Travels
We may terminate this Agreement for non-payment, failure to provide required information, or inappropriate behavior. All paid fees remain non-refundable.
13. Acceptance of Terms
By submitting payment, engaging Magic Family Travels, or authorizing us to begin planning, you confirm that you have read, understood, and agree to these Terms and Conditions.
